Your use of the Services is subject to this Acceptable Use Policy. If you are found to be in violation of our policies at any time, as determined by CloudSoul S.à r.l. (“CloudSoul,” “we,” “us,” or “our”) in its sole discretion, we may warn you, suspend access, or terminate your account.
We may change this Acceptable Use Policy at any time. Pursuant to the CloudSoul Terms of Use (the “Terms”), it is your responsibility to keep up to date with and adhere to the policies posted here. All capitalised terms used herein have the meanings stated in the Terms, unless stated otherwise.
PROHIBITED CONTENT
The Content displayed and/or processed using the Services shall not contain any of the following types of content:
- Content that infringes a third party’s rights (e.g., copyright) according to applicable law;
- Excessively profane content;
- Hate-related or violent content;
- Content advocating racial or ethnic intolerance;
- Content intended to advocate or advance computer hacking or cracking;
- Content that promotes illegal gambling;
- Other illegal activity, including without limitation illegal export of controlled substances or illegal software;
- Drug paraphernalia;
- Phishing;
- Malicious content;
- Other material, products, or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third-party rights.
PROHIBITED ACTIONS
In addition to (and as some examples of) the violations described in the Terms, you may not, and may not allow any third party (including your Authorised Users) to:
- Generate or facilitate unsolicited commercial email (“spam”). Such activity includes, but is not limited to:
- sending email in violation of any applicable anti-spam law;
- imitating or impersonating another person or his, her, or its email address, or creating false accounts for the purpose of sending spam;
- data-mining any web property (including CloudSoul) to find email addresses or other user account information;
- sending unauthorised mail via open, third-party servers;
- sending emails to users who have requested to be removed from a mailing list;
- selling, exchanging, or distributing to a third party the email addresses of any person without such person’s knowing and continued consent to such disclosure;
- sending unsolicited emails to significant numbers of email addresses belonging to individuals or entities with whom you have no preexisting relationship.
- Send, upload, distribute, or disseminate any unlawful, defamatory, harassing, abusive, fraudulent, infringing, obscene, or otherwise objectionable content;
- Intentionally distribute viruses, worms, defects, Trojan horses, corrupted files, hoaxes, or any other items of a destructive or deceptive nature;
- Conduct or forward pyramid schemes and the like;
- Transmit content that may be harmful to minors;
- Impersonate another person (via the use of an email address or otherwise), or otherwise misrepresent yourself or the source of any email;
- Illegally transmit another’s intellectual property or other proprietary information without such owner’s or licensor’s permission;
- Use the Services to violate the legal rights (such as rights of privacy and publicity) of others;
- Promote or encourage illegal activity;
- Interfere with other users’ enjoyment of the Services;
- Perform significant load testing without first obtaining CloudSoul’s written consent (email permitted), as otherwise such testing may be treated as a denial-of-service attack;
- Sell, trade, resell, or otherwise exploit the Services for any unauthorised commercial purpose;
- Modify, adapt, translate, or reverse engineer any portion of the Services;
- Remove any copyright, trademark, or other proprietary rights notices contained in or on the Services;
- Reformat or frame any portion of the web pages that are part of the Services’ administrative interface;
- Use the Services in connection with illegal peer-to-peer file sharing;
- Display any content on the Services that contains any hate-related or violent content, or any other material, products, or services that violate or encourage conduct that would violate any criminal laws, any other applicable laws, or any third-party rights;
- Modify the CloudSoul logo or any other CloudSoul Marks;
- Use the Services to operate an “open proxy” or any other form of Internet proxy service that is capable of forwarding requests to any end user or third-party-supplied Internet host;
- Use the Services to access a third-party web property for the purposes of web scraping, web crawling, web monitoring, or other similar activity through a web client that does not take commercially reasonable efforts to:
- identify itself via a unique User Agent string describing the purposes of the web client;
- obey the robots exclusion standard (http://www.robotstxt.org/robotstxt.html), also known as the robots.txt standard, including the crawl-delay directive;
- Use the Services, or any interfaces provided with the Services, to access any CloudSoul product or service in a manner that violates the Terms or other terms and conditions for use of such CloudSoul product or service.
SPECIFIC TO SECURITY OPERATIONS
CloudSoul provides security operations capabilities, detection logic, and access to operational tooling. Because these capabilities can be misused, the following are expressly prohibited:
- Use against systems you do not own or are not authorised to test. You may not use the Services, or any data, output, or capability obtained through the Services, to scan, probe, attack, monitor, or otherwise act against any system, network, account, application, or data that you do not own or for which you do not hold explicit, current written authorisation from the rightful owner. This includes, without limitation, any form of penetration testing, red-teaming, vulnerability assessment, or threat-emulation activity directed at third-party assets.
- Reverse engineering of detection logic and rule sets. You may not, directly or indirectly, reverse engineer, decompile, disassemble, copy, extract, export, sell, distribute, or otherwise derive the source or structure of any CloudSoul detection rule, signature, query, playbook, model, threat-intelligence content, or other proprietary detection logic, in whole or in part, except to the extent such restriction is prohibited by applicable law. You may not use the Services to systematically infer, reconstruct, benchmark, or evade CloudSoul’s detection content for any purpose.
- Sharing access between organisations. Access to the Services is granted to your organisation alone. You may not share, transfer, sub-licence, lease, or otherwise make access to the Services, your account, or any Authorised User credentials available to any third party or to any other legal entity, including parent, subsidiary, or affiliated entities not covered by your Order Form. Access by managed service providers, consultants, or contractors acting on your behalf is permitted only where explicitly authorised in your Order Form or in a separate written agreement with CloudSoul.
Violations of this section may, in addition to suspension or termination, give rise to immediate liability and to legal action by CloudSoul or by affected third parties.
